These Terms and Conditions (“Terms of Use”) govern your use of our services. As used in these Terms of Use, ‘FLYLOG.io application,’ ‘FLYLOG.io services,’ ’the App,’ ’the Service,’ or ’the service’ means the FLYLOG.io application, including all features and functionalities, the website, user interfaces, mobile apps, and all content and software associated with our service.

By accessing, subscribing, or using FLYLOG.io services, you are accepting this Agreement. You should read these Terms of Use carefully before using our services. If you do not agree with these Terms of Use, please refrain from using FLYLOG.io services and websites.

We reserve the right to change our Terms and Conditions of Use at any time and for any reason. Such changes will take effect on the posted date (i.e., the “Last Update Date” of these Terms of Use).

1. Service Provider

The “FLYLOG.io" application (the “App”), available at www.flylog.io, app.flylog.io, the Apple App Store and the Google Play Store App, is owned and operated by Breele s.r.o, (a limited liability company), Prague, Czech Republic, European Union. 

1.1. FLYLOG.io services are provided for individual users (pilots) and for business organizations under “FLYLOG.io for Business.” Unless otherwise agreed in a separate written contract, these Terms of Use apply equally to both types of services.

2. Your Consent to the Service

2.1. You must be over 18 or the age of majority in your province, territory, or country to use the FLYLOG.io service. 

2.2. You agree to use the FLYLOG.io service, including all features and functionalities associated, in compliance with all applicable laws, rules, and regulations, as well as any other restrictions on the use of the service or content therein.

2.3. You also agree not to decompile, reverse engineer, or disassemble any software or other products or processes accessible through the FLYLOG.io service; nor insert any code to manipulate the FLYLOG.io service destructively.

2.4. In addition, you agree not to upload, post, email, or otherwise send or transmit any material designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment associated with the FLYLOG.io service, including any software viruses or any other computer code, files, or programs.

2.5. The FLYLOG.io software is developed by, or for, Breele s.r.o. and is designed to enable the management, storage, and viewing of data through web-browser-enabled devices and mobile devices running iOS and Android operating systems. The FLYLOG.io software may vary by device and medium, and functionalities and features may differ between devices. You acknowledge that the use of the service may require third-party software that is subject to third-party licences. You agree that you may automatically receive updated versions of the FLYLOG.io application, user interface, and related third-party software.

2.6. Users are forbidden to enter non-existing flights (flights without real aircraft or flight simulators for pilot training).

2.7. For FLYLOG.io for Business accounts, the organization is responsible for ensuring that Admins manage user access, billing, and compliance with applicable aviation regulations.

2.8. For Business accounts, the organization is responsible for all activities carried out under its account, including the actions of Admins and authorized users. FLYLOG.io shall not be liable for any misuse of the service by the organization’s Admins or users.

3. Subscription, Payments & Billing

3.1. Free Trial Period

3.1.1. Your subscription starts with a free trial. The free trial period of your subscription is limited and is intended to allow new users and certain former users to try the service.

3.1.2. FLYLOG.io determines free trial eligibility at its sole discretion, and we may limit eligibility to prevent free trial abuse. We reserve the right to revoke the free trial and put your account on hold if we determine you are not eligible.

3.1.3. We may use information such as device ID, payment method or an account email address used with an existing or recent subscription to determine eligibility. For combinations with other offers, restrictions may apply.

3.1.4. For the Pilot Account (Basic & Premium plan), it is possible to enter up to 20 records; for the Business Account (Business plan), up to 50 records. After reaching the maximum number of “trial records”, you can continue with an active subscription only.

3.1.5. Data import is not included in the free trial. Users are responsible for preparing and uploading their own flight records. In certain cases, FLYLOG.io may assist with data imports; however, this service is optional, not guaranteed, and in the case of complex or legacy data, subject to an additional fee (see Section 8.7).

3.2. Activation of the Subscription

Pilot Subscriptions (Basic & Premium)
3.2.1. You can choose between Direct Subscription with payment card, (best price guaranteed) or an In-app subscription through the Apple AppStore or Google Play.

Business Subscriptions (Business)
3.2.2. FLYLOG.io for Business is available only as a monthly subscription plan — there are no one-time, annual, or lifetime plans. Subscription fees are calculated based on the number of aircraft in your fleet. There are no setup fees or hidden costs. Business subscriptions are billed monthly to the subscribing organization and administered by designated Account Admins. Invoices are issued automatically through the platform and cannot be issued manually. Any changes to billing details apply only to future invoices and will appear in the next billing cycle.

3.2.3. Your FLYLOG.io subscription will continue month-to-month (or year-to-year) until terminated. For information about subscription plans, please visit our pricing page. Please note that all prices shown do not include VAT tax if applicable. VAT tax is calculated and displayed during the checkout process.

3.2.3a. All subscriptions are non-refundable, and no credits are provided for unused periods, accidental purchases, or any other reasons, unless required by law.

3.2.4. To use the service, you must have Internet access and a compatible device and provide a current, valid, accepted method of payment, which you may update from time to time (“Payment Method”). Unless you cancel your subscription before your billing date, you authorise us to charge your next subscription fee to your Payment Method (see “Cancellation” below). You can find specific details regarding your subscription plan by visiting your Account profile under the section “Your plan”.

3.2.5. If payment is not successfully settled, we will immediately suspend your access to the service until the subscription is renewed. This usually happens for several reasons: your card has expired, lack of funds or funds on hold, or your bank declined the transaction for a reason unknown to us. In this case, please check your account profile and renew your subscription.

3.2.6. The invoice for the payment is available for download in your user profile. To check your transactions, navigate to your account and select “Transactions”. To ensure the desired information appears on the invoice (e.g., company name), please add it to your user profile. Please note that new invoices cannot be issued manually. Any changes to your billing details will only apply to future invoices and will appear in the next billing cycle.

3.2.7. We ensure secure card payments through trusted transactional payment providers, Stripe and PayPal/Braintree.

3.3. Mobile In-App Subscriptions

3.3.1. In-app subscriptions (Apple App Store or Google Play) provide full access to both the mobile app and the web app when signed in with the same credentials used for the initial purchase.

3.3.2. FLYLOG.io cannot manage or modify in-app subscriptions purchased through the Apple App Store or Google Play. If you wish to cancel your subscription, you must do so directly through the Apple App Store or Google Play.

3.3.3. For more information, see Section 3.5 (“Cancellation of the Subscription”).

3.4. Billing Cycle

3.4.1. The subscription fee will be charged on a monthly or yearly basis to your Payment Method on the calendar day corresponding to the commencement of your paid subscription.

3.4.2. In some cases, your payment date may change, for example, if your Payment Method has not settled successfully or if your subscription began on a day not contained in a given month or year. Visit your Account profile to see your next payment date.

3.5. Cancellation of the Subscription

3.5.1. Pilot Accounts: You can cancel your subscription at any time. You will continue to have access to the FLYLOG.io service through the end of your current billing period. After this period, your account will be suspended.

3.5.2. Business Accounts: Only the designated Account Admin may initiate cancellation. Before ending the subscription, the Admin must ensure that no flights, reservations, or maintenance tasks are scheduled beyond the cancellation date. After the billing period ends, the account will be suspended and scheduled for deletion.

3.5.3. To cancel, go to your Account profile and follow the instructions. If you cancel your subscription, your account will automatically be suspended at the end of your current billing period. To see when your account will close, check your Account profile.

3.5.4. If you subscribed through a third party (Apple App Store, Google Play Store) and wish to cancel your subscription, you must do so directly through that third party.

3.5.5. To the extent permitted by applicable law, subscription payments are non-refundable, and we do not provide refunds or credits for partial subscription periods. If, at our sole discretion, we make an exception and issue a refund, a processing fee of 20 USD or 20 EUR (depending on the original payment currency) will be deducted from the refunded amount to cover refund processing and administrative costs.

3.5.6. We are not obligated to provide any services or support to users without an active subscription. We strongly recommend that you download your data before cancellation. We reserve the right to charge a fee for data recovery if your account is suspended due to non-payment or if a payment dispute is raised with your bank.

3.6. Data Retention

3.6.1. Pilot Accounts (Basic & Premium): We retain your data on our servers for 12 months to facilitate subscription recovery. After this period, your data will be permanently deleted and cannot be recovered. You may delete your data sooner at any time by using the “Permanently Delete My Data” option in your account profile. When selected, your data will be immediately removed from active systems. For up to 14 days, limited recovery may still be technically possible (e.g., from system backups), but this is not guaranteed. After 14 days, your data will be permanently deleted from all systems and backups.

3.6.2. Business Accounts (Business): Business account data is retained for 30 days after cancellation, then permanently deleted unless otherwise agreed in writing. Customers may request earlier deletion of their data by contacting support@flylog.io. Business customers are solely responsible for exporting and securing their own data before cancellation or deletion; FLYLOG.io does not perform exports on behalf of customers.

4. Changes to Price and Service Plans

We may occasionally update our service plans and pricing. We will notify you of changes at least 14 days before they take effect. These notifications will be sent electronically to the email address you provided.

5. Account Access & Passwords

5.1. The user who created the FLYLOG.io account and whose Payment Method is charged (the “Account Owner”) has access and control over the FLYLOG.io account. To maintain control over the account and prevent anyone from accessing the account, the Account Owner should maintain control over the devices used to access the service and not reveal the password nor details of the Payment Method associated with the account to anyone. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We can terminate your account or place your account on hold to protect you, FLYLOG.io, and our partners from identity theft or other fraudulent activity.

5.2. Accounts created but never activated, or without an active subscription within 6 months of creation, will be permanently deleted in line with our inactive account policy.

6. Data Ownership & Copyright

6.1. You are solely responsible for legality of data uploaded to the FLYLOG.io service by you or your automated device (smartphone, personal computer, etc.).

6.2. By using our service, you consent that anonymized or aggregated data may be used by FLYLOG.io for statistical analysis, service improvements, and limited marketing purposes (such as general usage trends). FLYLOG.io will not provide personal data to any third party for commercial or non-commercial purposes without your explicit consent.

6.3. For Business accounts, the organization remains the controller of all uploaded operational and customer data. FLYLOG.io acts solely as a processor providing hosting and technical services, unless otherwise agreed in a separate Data Processing Agreement (DPA).

7. Customer Support

7.1. Our typical response time is 24 - 48 hours. In the case of high-volume requests, priority is given to Premium plan subscribers and Business customers. Support is guaranteed only to customers with an active subscription.

7.2. We suggest referring to the user manuals if you need assistance using the features or our services. Please find out more on the Help webpages.

7.3. To contact our customer service, please use the email address support@flylog.io. No other contact methods are available.

8. Miscellaneous

8.1. Data Loss and Backup
We assume no liability or responsibility for any errors, omissions, mistakes, inaccuracies, or loss of data in the FLYLOG.io application or stored user data. As a user of the FLYLOG.io services (for pilots or organizations), it is your sole responsibility to back up your user data (flight logs, personal notes, certificates, attachments, customer data, etc.) and to keep these records separate from the FLYLOG.io app (e.g., in a CSV file, PDF, printed copy, paper logbook, spreadsheet). FLYLOG.io provides in-app backup options to assist you, but these do not replace your responsibility to maintain independent backups of your data.

8.2. User’s Responsibility for Backups
We strongly recommend that all users back up their data regularly. You can easily do this with iCloud, Google Drive, or your local drive. Backup files are generated in standard formats and can be opened in any spreadsheet editor, such as Apple Numbers, Google Sheets or Microsoft Excel. To access the backup feature, go to your user profile and scroll down to Backup.

8.3. Use at Your Own Risk
You use the information and features in FLYLOG.io at your own risk. We are not responsible for any damage, injury, or loss caused directly or indirectly by using the app.

8.3a. Limitation of Liability (Business Accounts): FLYLOG.io is not responsible for indirect losses, such as lost profits, revenue, data, or business opportunities, that may result from using the Business service. This does not limit our responsibility in cases of fraud, gross negligence, or any liability that cannot be excluded by law.

8.4. Governing laws
These Terms of Use shall be governed by and construed in accordance with the laws of the Czech Republic. Any litigation will be judged by a court in the Czech Republic under the laws of the Czech Republic.

8.5. Survival
If any provision or provisions of these Terms of Use are held invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect.

8.6. Electronic Communications
We will send you information relating to your account (e.g., payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration.

8.7. Data Import Services
FLYLOG.io is not obligated to import files or data on behalf of users. Each user is responsible for preparing and uploading their own logbook data in the supported formats. In certain cases, FLYLOG.io may assist with data imports; however, this service is optional, not guaranteed, and in the case of complex or legacy data, subject to an additional fee. Payment for such services will be processed separately via a secure Stripe payment link. More details are available on our Help page.
